Court findings reveal DHS agents used facial recognition technology during immigration operations, raising concerns over privacy rights.

WOODBURN, Ore — New technology DHS agents are using when conducting immigration sweeps is raising questions of constitutionality.

Agents are using an app called Mobile Fortify to scan people’s faces to try and identify them.

Body-worn camera footage of agents using this technology came out in court proceedings after a woman who was detained filed suit against the government for ICE’s arrest tactics.

“That is what they testified that they use to scan people’s faces to verify their identity because when they stopped them, they did not know who they were stopping,” Innovation Law Lab attorney Nelly Garcia Orjuela said.

The app compares information from databases to the face of who they are scanning, but Garcia Orjuela said sometimes the facial “matches” aren’t even the same person, which is what happened with her client.

“They tried to scan her face about three times, and every single time, it came up with a different result with a lady that was not even her,” Garcia Orjuela said.
