Planned Parenthood has been hit with a
lawsuit for allegedly transmitting website visitors’ sensitive health data to outside companies including Google, via analytics tools.

“Americans expect privacy when it comes
to their reproductive health information,” four individuals who visited Planned Parenthood’s website allege in a class-action complaint brought late last week in federal court in New York.

“That expectation is especially strong where disclosure could reveal a person’s sexual preferences, sexual orientation, or pregnancy status — and it has only intensified since
the U.S. Supreme Court ended the constitutional right to abortion,” the plaintiffs add in their complaint.

The plaintiffs, identified in court papers only by their initials, allege that that
Planned Parenthood’s website automatically transmits a host of information about users who attempt to book appointments online — including the services patients searched for, their ZIP codes and on a
page regarding abortion, a patient’s age and first day of their last menstrual period.

The complaint also alleges that the website’s “consent banner” — which asks consumers to
either accept or reject cookies — is misleading.

According to the complaint, people who attempted to reject tracking were “subjected to precisely the same conduct” as users who accepted
cookies.

The complaint includes claims that Planned Parenthood violates the federal wiretap law and a New York consumer-protection law.

Planned
Parenthood has not yet responded to MediaPost’s request for comment.
