This is intended to provide individuals with greater transparency in relation to how their personal information is handled by organisations.<\/p>\n<p>The Office of the Australian Information Commissioner (the <strong>OAIC<\/strong>) is currently undertaking a consultation process as part of its process for preparing guidance about the new automated decision making requirements.<\/p>\n<h2>New requirements<\/h2>\n<p>APP entities must disclose their use of automated decision making where it meets the following criteria:<\/p>\n<ul>\n<li data-list-item-id=\"ecbaa079173b078d8686efb13b4250498\">the entity has arranged for a computer program to make, or do a thing that is substantially and directly related to making a decision;<\/li>\n<li data-list-item-id=\"ed47da6bde830c6ed12118330ff3f0404\">the decision could reasonably be excepted to significantly affect the rights or interests of an individual; and<\/li>\n<li data-list-item-id=\"e096bea7103ee44c61e1d02a3912cbe3f\">personal information about the individual is used in the operation of the computer program to make the decision or do the thing that is substantially and directly related to making the decision.<\/li>\n<\/ul>\n<p>Where an APP entity uses automated decision making as outlined above, they are required to include information into their privacy policy about the:<\/p>\n<ul>\n<li data-list-item-id=\"e482b3529801512cfde138f68fe5e3895\">kinds of personal information used;<\/li>\n<li data-list-item-id=\"e74dcc8608b9e6c7020b01c17958f890b\">types of decisions made by the operation of the computer program; and<\/li>\n<li data-list-item-id=\"e06aacd0eedb7e7123ff53001a3566b3f\">types of decisions for which a thing, that is substantially and directly related to making the decision, is done by the operation of the computer program.<\/li>\n<\/ul>\n<p>The kinds of automated decision making that will fall under the new requirements will be those that significantly impact individuals, such as determining whether an individual is eligible for a home loan, insurance policy, making decisions in relation to jobs\/housing or where a decision impacts the individual&#8217;s access to healthcare services or other significant services\/supports.
