The LDPA, although the latest entrant in the ongoing waltz of state privacy laws, thankfully does not introduce any novel privacy compliance obligations. The LDPA is, however, an interesting mix of California- and Connecticut-style laws. Companies doing business in Louisiana should assess the applicability of the LDPA and, if necessary, prepare for LDPA compliance before the end of this year.<\/p>\n<h2>In Depth<\/h2>\n<h3>Who does the LDPA apply to?<\/h3>\n<p>The LDPA applies to a person or entity that conducts business in Louisiana and meets at least one of the following thresholds, which are borrowed from the California Consumer Privacy Act:<\/p>\n<ul>\n<li>Has an annual gross revenue greater than $25 million;<\/li>\n<li>Annually buys, receives, sells, or shares for commercial purposes the personal information of 75,000 or more consumers, households, or devices; or<\/li>\n<li>Derives 50% or more of its annual revenue from selling consumers\u2019 personal information.<\/li>\n<\/ul>\n<p>As with other state laws, \u201csale of personal data\u201d means \u201cthe exchange of personal data for monetary or other valuable consideration\u201d to a third party. A sale does not include disclosure of personal data to a processor, a third party for the purposes of providing a product requested by the consumer, or an affiliate, nor does a sale include the disclosure of information made publicly available by the consumer or made as part of a corporate transaction, such as a merger or acquisition.<\/p>\n<h3>Who is a consumer?<\/h3>\n<p>A consumer is a resident of Louisiana acting in an individual or household context. A consumer is not an individual acting in a commercial or employment context.<\/p>\n<h3>What is personal data?<\/h3>\n<p>The definition of \u201cpersonal data\u201d under the LDPA is a familiar one.
