The consultation on the\u00a0\u2019exposure draft\u2019 of the code, which is accompanied by an\u00a0explanatory statement, is being undertaken by the Office of the Australian Information Commissioner (OAIC). It follows extensive preliminary engagement with children, families,\u00a0industry\u00a0and civil society, and is aimed at responding to growing concern about the scale and sensitivity of personal information collected about children in digital environments. The consultation is open\u00a0until 5 June 2026. The final code must be registered by\u00a010 December 2026 \u2013 the same date that the\u00a0new privacy-related automated\u00a0decision making\u00a0(ADM) disclosure obligations\u00a0take effect.\u00a0\u00a0<\/p>\n

To support the process,\u00a0the OAIC has launched a dedicated\u00a0online\u00a0\u2018Privacy for Kids\u2019\u00a0hub, which brings together consultation materials, guidance and child\u2011facing resources intended to\u00a0provide more accessible information and encourage engagement form all stakeholders.\u00a0\u00a0<\/p>\n

Online service providers should use the consultation period to assess whether any of their services are likely to fall within the proposed scope of the code, to make submissions on any concerns they have about its impact, and to consider what uplifts to existing privacy governance settings may be\u00a0required.\u00a0<\/p>\n

Legal status<\/h3>\n

The code is being developed under the\u00a0amendments made\u00a0in 2024\u00a0to the\u00a0Privacy Act 1988\u00a0(Cth) by the\u00a0Privacy (Online Services and Other Measures) Act 2024\u00a0(Cth), which mandates the\u00a0Privacy Commissioner\u00a0to\u00a0develop and register\u00a0a children\u2019s online privacy code.\u00a0\u00a0<\/p>\n

Once registered, the code will\u00a0operate\u00a0as a binding legislative instrument\u00a0under the\u00a0Privacy Act, specifying how online services\u00a0that are subject to the code\u00a0must\u00a0comply with\u00a0the obligations in the Australian Privacy Principles (APPs) and imposing child\u2011specific obligations.\u00a0Importantly, APP codes may also apply to acts or practices that would otherwise be exempt from the Privacy Act, including exemptions to employee records and…<\/p>\n
