On March 20, 2026, Governor Stitt signed Senate Bill 546 into law, establishing Oklahoma\u2019s Act Relating to Data Privacy and making Oklahoma the 21st state to enact a comprehensive consumer privacy law. Although the Act does not become effective until January 1, 2027, businesses should act now to prepare for its requirements.<\/p>\n<h2>Who must comply?<\/h2>\n<p>The Act applies to businesses that:<\/p>\n<ul style=\"list-style-type: square;\">\n<li class=\"dm-caption\">Do business in Oklahoma or target Oklahoma residents with goods or services; and<\/li>\n<li class=\"dm-caption\">Either\n<ul style=\"list-style-type: square;\">\n<li class=\"dm-caption\">Control or process personal data of at least 100,000 Oklahoma consumers in a calendar year; or<\/li>\n<li class=\"dm-caption\">Control or process personal data of at least 25,000 Oklahoma consumers and earn over 50% of their revenue from selling personal data.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>The Act includes several exclusions and exemptions, however, including for the following:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Nonprofit entities<\/li>\n<li>Colleges and universities<\/li>\n<li>State agencies<\/li>\n<li>Information collected for employment purposes or administering employee benefits<\/li>\n<li>Certain entities and data subject to HIPAA<\/li>\n<li>Certain entities and data subject to the Gramm-Leach-Bliley Act<\/li>\n<\/ul>\n<h2>What is required?<\/h2>\n<p>Businesses subject to the Act have several obligations regarding how they treat personal information and how they disclose the same to consumers.
