{"id":231193,"date":"2026-04-04T15:22:00","date_gmt":"2026-04-04T19:22:00","guid":{"rendered":"https:\/\/news-you-need.com\/index.php\/2026\/04\/04\/bail-conditions-cant-invade-privacy-of-kin-of-accused-delhi-hc-delhi-news\/"},"modified":"2026-04-04T15:30:13","modified_gmt":"2026-04-04T19:30:13","slug":"bail-conditions-cant-invade-privacy-of-kin-of-accused-delhi-hc-delhi-news","status":"publish","type":"post","link":"https:\/\/news-you-need.com\/index.php\/2026\/04\/04\/bail-conditions-cant-invade-privacy-of-kin-of-accused-delhi-hc-delhi-news\/","title":{"rendered":"Bail conditions can\u2019t invade privacy of\u00a0kin of accused: Delhi\u00a0HC | Delhi News"},"content":{"rendered":"<p><a href=\"https:\/\/timesofindia.indiatimes.com\/city\/delhi\/bail-conditions-cant-invade-privacy-ofkin-of-accused-delhihc\/articleshow\/130026308.cms\">Bail conditions can\u2019t invade privacy of\u00a0kin of accused: Delhi\u00a0HC | Delhi News<\/a><\/p>\n<p><a href=\"https:\/\/timesofindia.indiatimes.com\/city\/delhi\/bail-conditions-cant-invade-privacy-ofkin-of-accused-delhihc\/articleshow\/130026308.cms\">https:\/\/timesofindia.indiatimes.com\/city\/delhi\/bail-conditions-cant-invade-privacy-ofkin-of-accused-delhihc\/articleshow\/130026308.cms<\/a><\/p>\n<p>Publish Date: <a href=\"publish_date]\">2026-04-04 15:22:00<\/a><\/p>\n<p>Source Domain: <a href=\"timesofindia.indiatimes.com\">timesofindia.indiatimes.com<\/a><\/p>\n<p>  <span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">New Delhi:<\/span> Underlining the right to a person\u2019s privacy, Delhi High Court has said that bail conditions can\u2019t be imposed on the kin of an accused or convict.<span class=\"id-r-component br\" data-pos=\"4\"\/>In a recent order, the high court has set aside certain bail conditions that warranted the police to carry out surveillance of an accused person\u2019s wife and also monitor her call detail records.<span class=\"id-r-component br\" data-pos=\"7\"\/>It termed the conditions imposed by the trial court as an unjustified invasion of privacy and extended the interim bail for a limited period to enable the accused petitioner to attend to his wife\u2019s surgery.<span class=\"id-r-component br\" data-pos=\"9\"\/>\u201cThe law only empowers the court to impose appropriate conditions on the undertrial or convict to whom bail or suspension of sentence is being granted; while doing so, the court cannot impose conditions on the family members of the accused or convict,\u201d Justice Anup J Bhambhani observed in the order.<span class=\"id-r-component br\" data-pos=\"13\"\/>Seeking modification of the bail conditions imposed, the accused had argued that the conditions are an unacceptable invasion of the privacy of his wife, who has no concern with the FIR in question.<span class=\"id-r-component br\" data-pos=\"15\"\/>The prosecution submitted that the accused had availed interim bail earlier too on the same ground but the surgery was not conducted.<span class=\"id-r-component br\" data-pos=\"17\"\/>However, the public prosecutor conceded that the conditions regarding the accused\u2019s wife \u201cmay not be appropriate since they amount to unwarranted surveillance and invasion of the privacy of the petitioner\u2019s wife\u201d.<span class=\"id-r-component br\" data-pos=\"20\"\/>The trial court, in its interim order, had directed the police to file a report on the family members of the accused\u2019s wife who had visited her, and ordered that a woman police officer be deputed to stay with her.<span class=\"id-r-component br\" data-pos=\"22\"\/>It had further sought a report on the circumstances in the accused\u2019s wife\u2019s house by clicking photographs of her and noting down statements from three neighbours regarding her lifestyle.
