The adage that a man\u2019s home is his castle isn\u2019t about authority. It\u2019s about protection \u2014 the walls that keep others out.<\/p>\n

But even strong walls need a door.<\/span><\/p>\n

We understand that instinctively. Police need a warrant.<\/span><\/p>\n

But that shorthand doesn\u2019t quite capture what the Constitution actually does.<\/span><\/p>\n

The Fourth Amendment doesn\u2019t depend on whether you lock the door. It requires the government to have a key.<\/span><\/p>\n

The Fourth Amendment addresses both:<\/span><\/p>\n

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated,and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.<\/p>\n

It secures the lock \u2014 and defines the key.<\/span><\/p>\n

The Fourth Amendment has spent more time in court than most, because its text demands it every time the government acts.<\/p>\n

That isn\u2019t an accident. It\u2019s exactly the point.<\/span><\/p>\n

Like other parts of the Bill of Rights, this sistered right and responsibility \u2014 two pieces joined to make something stronger \u2014 exists for a reason. The colonies had already seen what happened without it.<\/span><\/p>\n

Under British rule, general warrants gave officials broad authority to search almost anything without limits or justification.<\/span><\/p>\n

\u201cYou could think of a general warrant as a kind of blank check for the government official who is executing the warrant,\u201d said Joshua Windham, a senior attorney with the Institute for Justice. <\/span><\/p>\n

There was no independent check \u2014 the same people authorizing the searches were often the ones carrying them out.<\/span><\/p>\n

The Fourth Amendment doesn\u2019t just grant the right to defend your space. It doesn\u2019t hand the keys to the government, either. It recognizes that both have a role \u2014 and that it takes a third party to weigh the argument and decide whether the door can be opened.<\/span><\/p>\n
