This bill will provide clear rules for law enforcement, safeguard privacy, and strengthen public trust without compromising public safety.\u201d\u00a0<\/strong><\/p>\n<p><span style=\"text-decoration:underline\">SB26-070<\/span>, cosponsored by Senator Lynda Zamora Wilson, R-El Paso County, would establish a framework that preserves law enforcement\u2019s ability to protect public safety while ensuring that access to historical location information collected by ALPRs complies with the Fourth Amendment.<\/p>\n<p>To establish these standards, the bill would:\u00a0<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Require law enforcement to attain a valid warrant to access historical location information, except for limited exceptions like emergency situations where a warrant is deemed impractical;<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Prevent data sharing with out-of-state agencies, except under clearly defined circumstances or court order;<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Prohibit the sale of historical location data;<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Mandate the creation of a detailed data access record as well as routine audits and public reports;<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Limit the length of time historical information may be retained to 30 days, unless a warrant or active investigation justifies longer retention; and<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Authorize the Attorney General to seek injunctive relief for intentional violations.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" style=\"white-space:pre-wrap;\">ALPR technologies, like Flock cameras, have <span style=\"text-decoration:underline\">raised concerns<\/span> in recent years, and their <span style=\"text-decoration:underline\">use in immigration enforcement operations<\/span> has sparked outrage <span style=\"text-decoration:underline\">in Denver<\/span> and <span style=\"text-decoration:underline\">cities <\/span><span style=\"text-decoration:underline\">across <\/span><span style=\"text-decoration:underline\">Colorado<\/span>.
