Every year, Americans say they care about privacy. And every year, after yet another massive data breach, almost nobody leaves the platforms that lost their data.<\/span>\u00a0<\/span><\/p>\n

Europeans behave differently. They complain. They file regulatory actions. They switch services. Sometimes they even force outcomes.<\/span>\u00a0<\/span><\/p>\n

That difference\u00a0isn\u2019t\u00a0accidental.\u00a0It\u2019s\u00a0cultural. And it shows up everywhere, from how surveillance is tolerated to the level of trust people place in the systems that handle their data.<\/span>\u00a0<\/span><\/p>\n

Now Europe is changing how it regulates technology. Through a new \u201cdigital omnibus\u201d package, the\u00a0<\/span>European Commission proposes to delay certain aspects of the AI Act<\/span>, simplify compliance, and amend the GDPR to make AI development more practical. The official line is \u201csimplification, not deregulation.\u201d<\/span>\u00a0<\/span><\/p>\n

That framing is mostly fair. But\u00a0it\u2019s\u00a0still a real shift. For years, the EU positioned itself as the global standard-setter for digital regulation.\u00a0Now it\u2019s openly acknowledged that this approach has to adapt as AI starts reshaping how software actually works.<\/span>\u00a0<\/span><\/p>\n

Here\u2019s\u00a0what\u2019s\u00a0easy to miss in all the policy debate: as AI systems start making decisions and taking actions on our behalf, the gap between the U.S. and Europe\u00a0isn\u2019t\u00a0shrinking.\u00a0It\u2019s\u00a0becoming more consequential. The most important shifts in privacy and security\u00a0won\u2019t\u00a0come from new rules.\u00a0They\u2019ll\u00a0come from whether the systems\u00a0we\u2019re\u00a0building are even capable of honoring any rules at all.<\/span>\u00a0<\/span><\/p>\n

Two Systems. Two Very Different Assumptions<\/h3>\n

At a structural level, the difference starts with how each system thinks about data.<\/span>\u00a0<\/span><\/p>\n

In Europe, privacy law begins\u00a0from\u00a0the assumption that personal data belongs to the individual. The\u00a0<\/span>GDPR<\/span>\u00a0is built around consent, purpose limitation, and user rights, and companies have to justify why they\u2019re allowed to collect and use data in the first place.<\/span>\u00a0<\/span><\/p>\n

In the U.S., we still\u00a0don\u2019t\u00a0have a federal privacy law. Instead, we have a patchwork of state rules…<\/span><\/p>\n
