OAK CREEK, Wis.—A federal judge has allowed much of a proposed class-action privacy lawsuit against Guardian Credit Union to move forward, ruling that member David Gassman plausibly alleged the credit union tracked visitors to its website and shared personal financial information with third parties.
The suit, filed in U.S. District Court for the Eastern District of Wisconsin, claims the $291-million Guardian used code-based tracking tools on its website to collect data from members accessing accounts, financial services and product applications. Bloomberg Law reported the complaint alleged information was shared with Google, LinkedIn, DoubleClick and other third parties.
Guardian moved to dismiss all 17 claims, arguing its use of common web analytics “pixels” to gather anonymized information was lawful and disclosed through its privacy policy. U.S. District Judge Brett Ludwig rejected that argument at the pleading stage for several claims, saying disputes over whether the information was personal financial information and whether the privacy policy was misleading could not be resolved before discovery, according to court documents.
The court dismissed eight counts, including invasion of privacy, negligence per se, Stored Communications Act and Computer Fraud and Abuse Act claims. But nine claims survived, including negligence, contract-related claims, Wisconsin deceptive-trade and consumer-protection claims, a Wisconsin electronic-surveillance claim and two federal Electronic Communications Privacy Act claims. Guardian has denied wrongdoing, and the ruling does not determine liability.
